## Board briefing

Peru is an open, growing, newly-regulated online market with a clear MINCETUR licensing pathway and moderate tax.

#### What has changed

- Ley 31557 is fully in force; 50+ operators authorised since March 2024; a new 1% ISC per bet took effect July 2025; MINCETUR created a dedicated Directorate in 2025.

#### What to do now

- Incorporate a Peruvian entity, post the ~USD 235k guarantee, certify platform/games to Peruvian norms, secure a .bet.pe domain, and stand up AML and 18+ verification before applying.

#### What to watch

- ISC implementation/recertification burden, possible advertising tightening following regional precedent, and continued payment-rail enforcement against unlicensed operators.

### Peru Gambling — Overview

Peru operates a mature, MINCETUR-administered remote gambling and sports-betting regime under Ley 31557 as amended by Ley 31806, a durable primary statute establishing a unified authorization pathway. Full analysis · 110 words Peru operates a mature, MINCETUR-administered remote gambling and sports-betting regime under Ley 31557 as amended by Ley 31806, a durable primary statute establishing a unified authorization pathway. The market has grown to over ninety licensed operators, and Peru was named Regulator of the Year 2025 by the International Masters of Gaming Law, a Uncertain-confidence but internationally-facing signal of comparative regulatory standing. The jurisdiction-family posture is civil-law, meaning the enforcement theory rests on the statutory licensing stack itself rather than a secondary licence-breach doctrine. This cycle's overall trajectory is positive for licensed operators: growing licensee counts and no adverse legal-posture change, set against a backdrop of intensifying enforcement against unlicensed activity.

- Local entity/branch and ~USD 235k guarantee requirement
- New 1% ISC per-bet tax (from July 2025) raising effective burden
- Mandatory .bet.pe domain and real-time MINCETUR data access
- Still-maturing technical certification and enforcement build-out

4 Oct 2026 Read update Peru's gambling regime remains structured around Ley N 31557 for remote gaming and sports betting, with the current cycle marked by continued enforcement pressure rather than structural change. Mincetur's DGJCMT has blocked 86 of 157 identified unauthorised remote-gaming and sports-betting platforms through 2 October 2026, alongside closure of 17 physical betting shops and 10 slot-machine halls and thousands of inspections. In parallel, a previously archived bill to cut the online-gambling ISC rate from a 20% ceiling to a Ministry of Economy and Finance-set band of 0.3% to 7% has been revived in Congress. Neither development alters the licensing architecture itself, but together they define an amber posture: active enforcement against unauthorised supply alongside unresolved uncertainty over the tax base facing licensed operators.

Peru has enacted legislation to regulate Remote/Online Gaming and online Sports betting by publishing Law no. 31,557 in the Government Gazette on the 13th of August 2022. The relevant law is titled ‘Law Regulating Remote Gaming and Remote Sports Betting’, it was subject to a reform by the Law no. 31806 from 8th June 2023 and finally implemented by the Supreme Decree No 005-2023 from 13th October 2023, issued by the Peruvian Ministry of Foreign Trade and Tourism (MINCETUR) (the “Supreme Decree”).
The Peruvian regulatory framework distinguishes between Remote Sports Betting and Remote Gaming, as the two authorized verticals and each will require its own licence.
Remote Sports Betting consists of a remote game, wherein the result of a sporting event or any other fact or circumstance that may occur in said sporting event is wagered. Only those sporting events that are part of a national or international association, sports federation or league duly accredited and authorized in the country of origin are enabled for betting. Electronic sports (e-sports), fantasy sports and virtual sports are considered part of Sports betting.
The remote games vertical includes games of chance that may include components of skill or dexterity, which involve placing bets other than remote sports betting.
The Supreme Decree has included under the category of remote games multiple-bet games, line games, Card Games, Poker Games, Blackjack, Roulette, Dice, Simulation of Sports or racing games, Balls/number extraction games, Keno or bingo games, Immediate Prize Games and Live Games.
The main elements of the Remote games and remote sports betting legislation include the introduction of:
A competent supervisory authority. The Peruvian Ministry of Foreign Trade and Tourism (MINCETUR) is the Government Body legally empowered to regulate and supervise the remote gaming industry through the General Directorate of Casino Games and Slot Machines (DGJMT).
A new licensing regime for the operation of technological platforms for remote gaming and remote sports betting open for legal entities incorporated in Peru, as well as any Branches opened in Peru of legal entities incorporated abroad, and legal entities incorporated abroad with a local legal representative.
Operators may use domains with the extensions ".bet.pe", ".bet", ".com", ".pe" or ".com.pe".
Licences for remote gaming and sports betting to be granted separately, for a period of six years with the possibility of renewal.
A fixed gaming tax of 12% of the operator’s monthly net income less the maintenance expenses of the technological platform of remote games, or remote sports betting, equivalent to two percent (2%) of the monthly net income.
1% consumption tax on the value of every bet placed by players residing in Peru.
A guarantee of circa EUR 850,000 per license must be made in favour of the regulator.
Player funds must be kept in a local bank account.
An authorization and registration procedure for technological platforms, games, progressive systems and other main components or services of technological platforms.
Technical requirements for the for technological platforms, games, progressive systems and other main components or services of technological platforms.
Responsible gaming measures.
Industry specific AML principles and regulations for the protection of minors.
Advertising and sponsorship restricted to authorized technological platforms.
Authorization of ‘remote sports betting halls’ which are localised retail points, within which players access a remote operator’s products and can also make payments.
Authorization of certification laboratories.
Blocking actions of unauthorized Websites, IP addresses, URLs and means of payment.
Currencies different than the national currency (Soles) can be offered by Operators (US Dollars or another currency). However, the use of cryptocurrencies is expressly prohibited by the new law.

## Market size
The total market size, including online and physical operations, is around EUR 1.25B in gross gaming revenue (GGR).
The online segment (remote sports betting and remote gaming) is estimated at around EUR 310M in GGR (approx. USD 350M), on online turnover of EUR 1.3B to 2.2B (approx. USD 1.5B to 2.5B).
Sports betting is the dominant vertical: it accounts for around 69% of online category interest, with live casino at around 11% and online poker at around 6%.
51 authorized domains
381 linked service providers have registered with MINCETUR, and 8 certification laboratories have been accredited:
GAMING LABORATORIES INTERNATIONAL LLC
ASENSI TECHNOLOGIES S.L.
BMM SPAIN TESTLABS S.L. UNIPERSONAL
QUINEL LIMITED
eCOGRA Limited
Global Lab Ltd.
GAMING ASSOCIATES EUROPE LTD
BMM North America, Inc.

## Competitive landscape
During the first year of the online gaming regime, MINCETUR granted authorizations to 59 operators for remote gaming and sports betting, approved 9 companies as certified laboratories, and registered 272 providers involved in remote gaming platforms, sports betting, data services, payment gateways, and integrators. International operators such as bet365, Betsson, Rush Street, and Kaizen are now competing with established local companies that have been in the market for years, boasting a strong local and retail presence.
We estimate around sixteen major operators in the market that conduct branding and advertising, have local partners, sponsor football teams, and have alliances with retail shops for payments. These will be expected to be licensed in the coming months and offshore operators will be sanctioned and geo-blocked.

## Localisation
Sports betting is the primary product offering in Peru as is the case for all LATAM, however online casino games including slots, tables as well as virtual bingo are also made available by operators in the offshore market.
An operator’s servers may be located either in Peru or abroad.
Peru’s financial institutions are viewed as stable with a BBB+ rating from Fitch in 2021. The Peruvian Sol is also one of the stronger currencies in Latin America, having less volatility against the US Dollar in the past five years.
Having a local retail network is suggested to optimise distribution and payments, since cash is still more popular than digital modes of payment in the territory.
Some general demographics from 2024 include:
Estimated Population: 34.9M
Political System: Regional Democracy, Peru is divided into 25 Regions
Average Age: 30.5
Population over 18: 71.4% circa 24.9M
Internet Penetration: 82%
Social Media Users: 28.3M
Active Mobile Connections: 40.03M
Web Traffic Originating from Android Devices: 84.5%
Web Traffic Originating from IOS: 14.8%
Active Bank Accounts: 65%
Active Credit Cards: 12%
70-75% of all E-commerce is generated in Lima

## Top Key Attractions and Challenges
## Attractions
Open style licensing regime as opposed to a monopoly/tender process.
Moderate advertising standards and regulations
Foreign entities with a registered local representative may apply for an authorization and registration as operators or service providers, without the need of incorporating a local entity or having a local branch or subsidiary.
Ability to on-board foreign players.( ID document: National ID document (DNI), in the case of Peruvian citizens, Immigration Card, in the case of foreign citizens residing in Peru or Passport for foreigners not residing in Peru)
Presence of major operators within the market, generating stable revenues.
A previously tolerated grey market has created an appetite for the remote gambling product, with an industry on the ground that is well positioned.
## Challenges
New tax regulations introduced following the implementation of the regulatory regime.
Requirement for a performance bond payment equivalent to Euro 850,000
Retail presence is required due to a preference for cash amongst players
Identity verification of customers must be done at the time of registration.
Platforms must have a self-diagnosis method that verifies periodically and authenticates all critical components that may affect game operations.

We consider the market to be an open one given the previous tolerance of offshore operators with a local presence and the introduction of sector specific legislation which seeks to create a balance between oversight, player protection and operators’ business needs.

4 Oct 2026 Read update Peru's online gambling and sports betting tax base is under active legislative contest. The current ISC regime applies a 20% ceiling that the Tribunal Constitucional has found confiscatory. Proposicion N 00389/2026-2031-CD, reactivated in the Camara de Diputados on 28 September 2026 after an earlier approval on 12 June 2025, an Executive observation in July 2025, and archiving in June 2026, would amend Articles 56(a)(3) and 61 of the IGV/ISC Law to let the Ministry of Economy and Finance set the applicable ISC rate within a 0.3% to 7% band. The Ministry's own estimate is that this would cut annual ISC collection on the sector by 90 to 95%, from approximately USD 82 million to USD 4-8 million. No new evidence this cycle addresses AML/CFT or responsible-gambling compliance lift, so the operator cost picture presented here is limited to the tax dimension; the 20% ceiling remains the position of record pending enactment.

14 Sep 2026 Read update The 12% GGR tax remains the stable core of Peru's cost-to-operate picture this cycle. The Impuesto Selectivo al Consumo on remote gaming and betting reverted to its statutory 1% rate from 1 July 2025, after a temporary 0.3% reduction expired. A congressional autógrafa narrowing the ISC calculation base and exempting non-domiciled platforms was approved by the Congress plenary on 12 June 2025 but was formally observed, in effect vetoed, by the Executive on 16 July 2025, and remains unresolved before Congress. This creates near-term cost uncertainty: operators cannot yet assume the narrower base or the foreign-platform exemption will take effect, since the outcome depends on whether Congress accepts the Executive's observations or pursues an override by insistencia. Until that standoff resolves, operators should plan around the current 1% ISC rate rather than the reform bill's terms.

6 Sep 2026 Read update The dominant cost-to-operate development this cycle is fiscal rather than regulatory: a Congress-passed bill to narrow the ISC tax base for remote gaming and betting was vetoed by the Executive on 16 July 2025 and, as of late June 2026, remained with the Congressional Pleno awaiting an insistencia vote or acceptance of the Executive's observation. Peru's Ministry of Economy and Finance separately denied preparing any increase to the ISC rate amid business-association concern, a Probable claim as of June 2026. Aggregator-cited figures citing a 12% GGR or 1% stakes ISC rate remain Uncertain, corroborated at tier-1 only for the underlying SUNAT collection mechanism and not for the aggregate rate itself. The net effect is an unresolved fiscal exposure for foreign-domiciled operators that could move materially depending on how the Pleno resolves the pending bill.

Full analysis · 769 words ## Application fees

Licence application fees per vertical (remote sportsbetting/remote games) is 273.10 PEN.

## Any required minimum guarantee

For the first year of operations, A performance guarantee of around EUR 850,000 (six hundred tax units (600 UIT) per license of remote gaming or remote sports betting is required.

The value of the guarantee must be updated in the following years of operation and shall equivalent to the figure that is greater between 3% of the annual net income or six hundred tax units (600 UIT). For this purpose, the difference between the annual gross income received in the previous fiscal year and the total amount of returns and prizes delivered in the same fiscal year will be considered.

Such guarantee must be granted by the Operator in favour of MINCETUR, in support of the obligations and sanctions derived from the operation, and may take the form of a bank deposit, bank bond letter or a surety policy, issued by a financial company, under the supervision of the Banking Superintendency and Insurance and Private Pension Fund Administrators (SBS).

The term of the guarantee is one (01) calendar year, which must be renewed for the same term, one

(01) month before the expiration date.

Certification laboratories must also issue a bank guarantee in favour of MINCETUR.

If the guarantee is not renewed after the expiration of the effective term, MINCETUR will revoke the authorization.

## Capitalisation requirement

The law does not mention a fixed capital requirement. The specific capital requirement for each applicant is determined based on the business plan submitted with the license application. Applicants must demonstrate they have adequate funds to cover the expenses outlined in their business strategy.

## Taxes

## Gaming tax

Operators are subject to a fixed gaming tax of 12% of the operator’s monthly net income (stakes and bonuses minus prizes and refunds) after deducting platform maintenance expenses equivalent to two percent (2%) of the monthly net income.

## Sales taxes

On 13 September 2024, the Executive enacted Legislative Decree 1644, which introduced a 1% selective consumption tax (Impuesto Selectivo al Consumo, ISC) applicable to remote gaming and sports betting activities regulated under Law No. 31557. The ISC entered into force on 1st January 2025.

The ISC applies to the value of each bet, including monetary amounts and bonuses with monetary value used for betting. The tax becomes payable when the relevant amount is debited from the player's gaming account to place the bet.

Online gaming or online sports betting is considered to be rendered or consumed within Peru when the bettor has habitual residence in the country. For this purpose, a bettor is deemed to have habitual residence in Peru, if any of the following conditions are met:

A Peruvian IP address

A Peruvian SIM card

A Peruvian credit or debit card

Peruvian domicile

The introduction of the ISC raised concerns among licensed operators due to the technological adjustments required to collect the tax on individual bets and the additional tax burden imposed alongside the existing 12% gaming tax.

Supreme Decree No. 008-2025-EF temporarily reduced the ISC rate from 1% to 0.3%, effective from 20 January to 30 June 2025. The statutory rate of 1% was reinstated on 1 July 2025 and remains applicable.

## Corporate taxes

Corporate tax in Peru is 29.5%

## Capitalisation / Bank guarantees

For the first year of operations, a performance guarantee of around EUR 850,000, specifically six hundred tax units (600 UIT) per license of remote gaming or remote sports betting is required.

28 Sep 2026 Read update The Ministry of Transport and Communications blocks websites, IPs, URLs and applications of unauthorised gambling operators as part of MINCETUR's enforcement chain, most recently applied against thirty-six platforms on 21 July 2026. Only a MINCETUR-notified domain on one of five permitted top-level domains, .bet.pe, .bet, .com, .pe or .com.pe, under Article 7.6 of Law No. 31557, may be used by a licensed operator; this restriction is the practical mechanism distinguishing licensed platforms from those subject to blocking. Active blocking activity continued and intensified alongside the July 2026 enforcement action, consistent with MINCETUR's stated ambition of inspecting the full remote gaming and betting sector during 2026.

Unlicensed operators may face administrative fines of up to 200 UIT, approximately EUR 275,000, alongside website blocking and restrictions on payment methods. Under the Third Final Complementary Provision of Law No. 31557, the Ministry of Transport and Communications (MTC), at MINCETUR's request, is responsible for blocking unauthorised websites, IP addresses, URLs and applications. MINCETUR may also request competent public or private entities to block payment methods associated with unauthorised operators, pursuant to Article 6(h) of the Law.

Enforcement activity increased during 2026. On 30 September 2026, MINCETUR notified 37 Directorial Resolutions ordering the blocking of unauthorised platforms. According to its announcement of 2 October 2026, 50 platforms were blocked in the latest enforcement round, bringing the total to 86 during 2026, against 157 platforms identified for blocking. MINCETUR also reported the removal of gaming content and payment methods associated with unauthorised websites.

In addition to administrative sanctions, Article 243-C of the Criminal Code, as amended by Law No. 31806, criminalises the unauthorised operation or exploitation of gambling activities, providing for imprisonment of one to four years, a fine of 365 day-fines and disqualification. However, no specific criminal enforcement proceedings against unauthorised online operators have been identified.

MINCETUR also monitors registered Linked Service Providers to ensure that they provide services exclusively to authorised operators. Failure to comply with this requirement may result in the revocation of their registration, preventing licensed operators from continuing to use their services on their platforms.

25 Oct 2026 Read update Mincetur ordered publication, via Resolución Ministerial N.° 382-2026-MINCETUR, of a draft Decreto Supremo amending the Reglamento of Ley N.° 31557 (approved as D.S. N.° 005-2023-MINCETUR). Opened to a fifteen-calendar-day public consultation beginning 21 October 2026, the draft proposes to cut the maximum fine for infracciones muy graves from 200 UIT to 70 UIT and to clarify operator obligations. The decree has not been adopted; the current 200 UIT ceiling remains in force pending the outcome of the consultation, expected to close around 5 November 2026. The scale of the proposed reduction, roughly two-thirds off the current ceiling for the most serious breach category, marks a substantive shift in the sanctions framework even while it stays at the proposal stage, and reads as a move toward calibrated rather than purely punitive enforcement. No enforcement events (fines issued, licences suspended or revoked) were identified; the development is confined to the proposed instrument itself.

12 Oct 2026 Read update MINCETUR's DGJCMT blocked 50 additional unlicensed remote-gambling and sports-betting platforms on 2 October 2026, bringing the cumulative 2026 total to 86 of 157 identified unlicensed targets. The blocking authority operates under Ley 31557 and its implementing decree, DS 005-2023-MINCETUR, the enabling statutory stack that continues unchanged. Sanctions available against an operator found offering regulated activity without MINCETUR authorisation include fines of up to 200 UIT, cancellation of authorisation, disqualification from holding future authorisation, and criminal referral carrying one to four years' imprisonment, giving the regulator both an administrative and a criminal route against unauthorised operators. Running alongside the blocking campaign, Resolución SBS N.° 01015-2026 (effective 8 April 2026) extended the SBS's SPLAFT anti-money-laundering obligations to MINCETUR-licensed remote-gaming and remote-sports-betting operators for the first time, repealing the 2016 rule that had applied only to physical casinos and slot machines, and layering a 24-hour no-threshold suspicious-transaction reporting duty and a USD 2,500 cash-exchange registration threshold onto the licensed population. Read together, the blocking campaign targets market access for the unauthorised and the SBS resolution tightens the compliance burden for the authorised, giving a licensed operator two separate and simultaneous fronts of regulatory attention to track as at October 2026.

4 Oct 2026 Read update Mincetur's Direccion General de Juegos de Casino y Maquinas Tragamonedas blocked 50 additional unauthorised remote-gaming and sports-betting platforms on 2 October 2026, bringing cumulative 2026 blocks to 86 of 157 platforms identified for blocking under Ley N 31557. The same campaign has closed 17 physical betting shops and 10 slot-machine halls, with 5,195 casino and slot-machine inspections and 4,572 platform and betting-shop inspections conducted to date. This is a staged, list-driven enforcement programme rather than an episodic action: more than half of the 157 identified targets have now been addressed. The formal Mincetur resolution underlying the 2 October action was not independently retrieved this cycle; the finding rests on corroborating press reporting from El Peruano and Gestion rather than the primary instrument, a gap recorded here rather than smoothed over. The practical consequence for an unlicensed operator is a materially rising probability of being blocked within the 2026 enforcement window; for a licensed operator, the campaign reduces unauthorised competitive pressure as the remaining target list is worked through.

28 Sep 2026 Read update MINCETUR blocked thirty-six unauthorised remote gaming and sports-betting platforms on 21 July 2026, an action confirmed in the official gazette and paired with a public appeal for citizens to report clandestine sports-betting, casino or slot-machine establishments. A February 2026 gazette notice recorded closure of a separate unauthorised betting venue and set out MINCETUR's stated aim to inspect 100% of remote gaming and betting activity nationwide during 2026. Trade-press reporting corroborates a sustained enforcement pattern beneath these headline actions: through 2025, seven illegal casinos or slot parlours and thirteen unauthorised betting locations were closed and 557 illegal slot machines destroyed, with operations continuing in 2026 across Puno, Lambayeque, Cajamarca, Lima and La Libertad. The enabling statute, Law No. 31557, together with its implementing Supreme Decree No. 005-2023-MINCETUR, treats unlicensed operation as an offence in itself rather than a licence-condition breach, which grounds the Ministry of Transport and Communications' website, IP and app-blocking function as a direct enforcement mechanism. Article 7.6's restriction of licensed operators to a MINCETUR-notified domain on one of five permitted top-level domains is the operative trigger identifying which platforms are blockable. The enabling Act carries durable standing; the associated decrees and inspection targets are administrative instruments subject to change at the Ministry's discretion.

21 Sep 2026 Read update MINCETUR enforcement intensified materially in 2026. A July 2026 action, reported at Probable confidence from a T1 MINCETUR source, blocked 36 unauthorised remote-gaming and sports-betting platforms and seized 39 slot machines, with 14 betting premises also actioned — the largest single enforcement event recorded this cycle. MINCETUR has separately stated a 2026 priority of 100 percent inspection coverage of remote sports-betting and remote-gaming activity nationally with real-time monitoring of licensees, though this posture claim rests on a single T4 secondary source at Probable confidence. Under Peru's civil-law enforcement theory, unlicensed operation is an offence under the primary Ley 31557 licensing stack itself, a durable statutory basis, rather than a secondary licence-breach theory; no enforcement action against a licensed operator was identified this cycle. The overall enforcement posture is assessed amber, reflecting materially increased intensity against the unregulated fringe relative to the prior baseline, not a deterioration in licensed operators' standing.

14 Sep 2026 Read update MINCETUR intensified enforcement against the unlicensed sector this cycle. In a single reported action on 21 July 2026, it blocked 36 unauthorised remote-gaming and sports-betting platforms and seized 39 slot machines, the largest single enforcement action in the recent record, drawn from a T4 source. This built on a broader 2026 pattern, corroborated at T3, of closures across Puno, Lambayeque, Cajamarca, Lima and La Libertad, where MINCETUR shut seven unlicensed remote-betting operations and two slot parlours. Separately, the SBS opened a fifteen-day public comment period in November 2025 on a draft resolution extending AML/CFT obligated-entity status to land-based casinos and slot halls, mirroring the framework SBS Resolution 03622-2025 already applies to online operators; UIF-Perú has yet to complete review of feedback, so this instrument remains fragile pending finalisation. None of these developments amends the primary licensing statute, Law 31557, which remains durable and unchanged. Taken together, they describe rising enforcement capacity and a widening compliance perimeter rather than a change in the rules governing who may hold a licence.

6 Sep 2026 Read update Peru's enforcement architecture rests on the statutory licensing stack established by Ley N 31557 and its implementing Reglamento (DS 005-2023-MINCETUR), with MINCETUR as the primary licensing and sanctioning authority. This cycle's material development is SBS Resolucion N 01015-2026, which replaces the 2016 casino AML rule and, per tier-3 reporting, extends LA/FT obliged-entity status to remote gaming and betting platforms for the first time; reported sanctioning authority for breaches sits with MINCETUR rather than SBS itself. This is a fragile regulator-circular instrument layered onto the durable enabling statute, and the claim is Probable rather than Confirmed pending tier-1 corroboration. A separate Uncertain claim holds that DS 005-2023-MINCETUR article 38.d prohibits licensed operators from processing cryptocurrency, sourced only to a tier-4 operator guide and unverified against the Reglamento text this cycle. No enforcement events were located this cycle beyond the supervisory-perimeter extension itself; no explicit safe-harbour doctrine was identified in the available claims.

3 Sep 2026 Read update MINCETUR's enforcement posture tightened materially this cycle, with a formal mandate for one hundred percent national inspection coverage of remote gaming and betting operations across 2026. The regulator reports this intensified inspection regime, together with existing authorisation and technical-oversight layers, has produced a reduction of roughly forty percent in illegal digital gambling supply. This figure and the inspection mandate itself are probable-tier findings sourced from a G3 Newswire interview with DGJCMT head Yuri Guerra, corroborated by a further industry outlet, rather than confirmed by a primary regulatory publication; the underlying enforcement action carries no separate durability rating, as it describes an operational programme rather than a specific legal instrument. Read against the registered-supplier ban regime, which permanently bars suppliers found servicing illegal platforms from the licensed market, the enforcement architecture functions through layered legal, technological, financial and operational levers rather than a single blocking mechanism, consistent with the civil-law pattern of enforcement resting on the statutory licensing stack rather than a secondary breach theory.

Full analysis · 542 words Since the implementation of the regulatory framework in February 2024, Peru has established a regulated market for remote gaming and sports betting, providing greater legal certainty for operators and facilitating access to local payment methods and advertising channels. However, the introduction of the Selective Consumption Tax (ISC) in January 2025 has increased the tax burden on operators, placing pressure on margins and contributing to market consolidation and the withdrawal of some operators.

The current tax framework imposes a 12% gaming tax on net gaming income, alongside a 1% ISC on the value of each bet. Although legislative proposals have sought to modify the ISC, the applicable rate remains unchanged. A bill approved by Congress in 2025 proposed changing the ISC taxable base to monthly income less prizes. However, the Executive objected to the proposal on 15 July 2025, and it was subsequently archived on 6 October 2026.

More recently, Bill No. 519/2026-2031-CD was introduced, proposing to increase the ISC rate from 1% to 5% of the value of each bet. As of November 2026, the bill remains under committee consideration. Separately, an initiative challenging the constitutionality of Law No. 31557 and certain provisions of Legislative Decree No. 1644 has progressed through the certification of signatures by the National Electoral Jury (JNE), although no ruling by the Constitutional Court has been identified. Neither development has affected the application of the current 1% ISC.

While the regulated market continues to offer opportunities for established operators, the potential increase in the ISC represents a significant regulatory risk that could further affect profitability and market participation. The medium-term outlook will largely depend on the evolution of the tax framework and the financial sustainability of licensed operations.

Bingo: The outlook is generally positive, subject to compliance with the applicable regulatory and technical requirements. However, the additional tax burden may affect the commercial viability of certain products.

Casino: The regulated framework has facilitated the operation of online casino products, including access to local payment methods and advertising opportunities. Nevertheless, the introduction of the ISC has increased operating costs, and any further increase in the tax rate could affect profitability and market growth.

Lottery: The outlook is generally positive, subject to compliance with the applicable regulatory and technical requirements. However, the additional tax burden may affect the commercial viability of certain products.

Poker: The outlook is generally positive, subject to compliance with the applicable regulatory and technical requirements. However, the additional tax burden may affect the commercial viability of certain products.

Skill games: The outlook is generally positive, subject to compliance with the applicable regulatory and technical requirements. However, the additional tax burden may affect the commercial viability of certain products.

Software/B2B: The outlook for B2B providers is generally positive. The regulatory framework strikes an appropriate balance between regulatory oversight and market accessibility. The establishment of a public registry of Linked Service Providers, which allows foreign suppliers to register through a local legal representative without incorporating a local entity, promotes legal certainty and transparency while avoiding burdensome requirements that could discourage market entry. It also enables MINCETUR to supervise registered providers and ensure that they supply services exclusively to authorised operators, thereby supporting enforcement against the unregulated market. Overall, the framework encourages B2B participation while maintaining effective regulatory oversight.

4 Nov 2026 Read update A draft Decreto Supremo amending the reglamento of Ley 31557 was published for consultation on 21 October 2026 via Resolución Ministerial No. 382-2026-MINCETUR. The draft would reduce the maximum fine for very serious infractions from 200 UIT to 70 UIT, and would tighten advertising conditions by confining promotion to currently authorised platforms, games and bets, requiring advertisements to identify the authorisation holder and its authorisation number, and prohibiting advertising directed at minors or that presents betting as a source of income, prestige or social success. Secondary reporting also indicates the draft would expand required reporting for authorisation holders while removing the existing requirement to permanently hand over user credentials to MINCETUR before starting operations, though the pinpoint provision for that change has not been confirmed against primary text. The public comment period runs approximately fifteen calendar days from publication, expected to close around 5 November 2026. No enactment date has been set, and the current reglamento remains in force until any decree is enacted.

25 Oct 2026 Read update The active reform item for Peru is a draft Decreto Supremo amending the Reglamento of Ley N.° 31557 (D.S. N.° 005-2023-MINCETUR), ordered published by Mincetur via Resolución Ministerial N.° 382-2026-MINCETUR on 21 October 2026. It opened a fifteen-calendar-day public consultation proposing to lower the maximum fine for infracciones muy graves from 200 to 70 UIT and to clarify operator obligations under the Reglamento. The consultation window is expected to close around 5 November 2026. No other reform item was identified. The decree, if adopted, would be the first amendment to the sanctions schedule since the Reglamento's 2023 approval, and its passage or revision during the consultation period is the near-term event that would move the regulatory posture from amber back toward settled.

4 Oct 2026 Read update Congress's Camara de Diputados reactivated Proposicion N 00389/2026-2031-CD on 28 September 2026, an autografa reviving a bill with a contested procedural history: originally approved by Congress on 12 June 2025, met with an Executive observation in July 2025, and archived in June 2026. The bill would let the Ministry of Economy and Finance set the ISC rate on online gambling and sports betting within a 0.3% to 7% band, replacing the 20% ceiling the Tribunal Constitucional found confiscatory, and separately criminalises sports-result manipulation. Its outcome remains undetermined given the repeated cycle of approval, observation, and archiving it has already been through. No other reform-horizon item surfaced this cycle.

28 Sep 2026 Read update Proyecto de Ley No. 9645 remains pending before the Senate. If enacted, it would authorise the Ministry of Economy and Finance to set the online-gambling Selective Consumption Tax anywhere between 0.3% and 7% of turnover without requiring a further congressional vote, replacing the current fixed 1% turnover-based rate. Commentary associated with the bill indicates that a rate set toward the top of that range could render a typical five-percent-hold sportsbook structurally unviable, making this the most material near-term commercial risk identified for the sector. The bill had not been enacted as of the most recent sourced commentary, and its progress through the Senate is the principal item to watch for any change to Peru's cost-to-operate picture.

21 Sep 2026 Read update MINCETUR has signalled four priorities for 2026: deepened technological oversight and traceability, intensified enforcement, continued regulatory refinement, and maintaining Peru's regional-benchmark standing. Reported working-group discussions between MINCETUR, MEF and SUNAT on tax-base and payment-gateway withholding-mechanic adjustments were noted this cycle at Uncertain confidence, since no specific bill number or consultation reference was located in the primary record. This reform signal warrants an amber watch posture: a clear regulatory-tightening intent exists for 2026, but without a named instrument yet, its practical shape and timing remain unresolved.

14 Sep 2026 Read update Two live reform tracks are unresolved this cycle. The SBS opened a fifteen-day public comment period in November 2025 on a draft resolution extending AML/CFT obligated-entity status to land-based casinos and slot halls, paralleling the online-sector framework under SBS Resolution 03622-2025; UIF-Perú is reviewing feedback before final approval, and the instrument remains fragile pending that outcome. Separately, a congressional autógrafa narrowing the ISC calculation base for remote gaming and betting and exempting non-domiciled platforms was approved by the Congress plenary on 12 June 2025, then observed (vetoed) by the Executive on 16 July 2025; it remains before Congress as of late June 2026, pending either acceptance of the Executive's observations or an insistencia override. Both tracks carry forward uncertainty that would, if resolved, materially change the compliance-cost and tax pictures for operators without altering the underlying licensing architecture.

6 Sep 2026 Read update The reform pipeline for Peru centres on the unresolved ISC Article 53/61 amendment dispute. Congress passed a bill narrowing the ISC base for remote gaming and betting, which the Executive vetoed on 16 July 2025; as of late June 2026 the bill sat with the Congressional Pleno awaiting either an insistencia vote to override the observation or acceptance of the Executive's position. The Ministry of Economy and Finance has separately, and probably, denied preparing any ISC rate increase, a statement made amid business-association concern in June 2026. No timeline for Pleno resolution was identified this cycle, and the outcome remains genuinely open heading into Q4 2026.
