Not reviewed Licensing in CA-TFN runs through the Tobique Gaming Commission (TGC) under the Tobique Gaming Act 2023, an instrument described in secondary sources as carrying durable statutory character notwithstanding the absence of a located primary text. The Act empowers TGC to issue gaming licences and designates Differentia Licensing Advisory Group Limited (DLAG) as the sole third-party Direct Licensee entitled to recommend applicants for licence issuance on Tobique's behalf, an assessed-confidence structural finding. The operative product licence, the Tobique Interactive/Remote Gaming Licence, is a low-confidence, fragile-sourced finding covering online casino, sports betting, poker, bingo, lottery-style games, skill-based gaming, and crypto-currency-funded gambling. Non-remote licensing is restricted to a single land-based casino within Tobique territory, an assessed-confidence, mixed-durability condition, while remote licensing is structurally oriented toward foreign markets. TGC's licensing apparatus is functioning and actively issuing licences, but every structural detail beyond the Act's existence and DLAG's gatekeeper role rests on commercial rather than regulator-published sourcing.

## Full section analysis

## Licence Triggers Apart from non-remote licences which currently are restricted to a single land based casino in Tobique, the jurisdiction is outward facing where licences are sought to operate from Tobique to target foreign markets. Therefore the trigger for licencing into Tobique is largely irrelevant. ## Type of Licence Needed All the below are specific licences that can be applied for: A non-remote bookmaker A remote bookmaker A non-remote betting intermediary’s licence A remote betting intermediatory licence A non-remote wagering licence A remote wagering licence A non-remote wagering machine licence A remote gaming software licence A remote gaming software aggregator licence A non-remote lottery promoter’s licence A remote lottery promoter’s licence A non-remote pools promoter’s licence A remote pools promoter’s licence A remote social gaming licence A remote game of skill licence ## Period of Licence & Renewal Process Licences are annual and renewable. An application for the renewal of a Licence shall be made to the DLAG not later three months prior to the date of the expiry of the current Licence. On receipt of an application which complies with the requirements and the Annual Licensing Fee of €18,0000, the TGC shall proceed to consider the application for renewal and shall then either: Grant the application by renewing the Licence for such period as may be specified in the Licence, subject to the existing terms or subject to such other terms as the TGC considers appropriate Give notice in writing to the applicant refusing the application for renewal Give notice in writing to the applicant that, before the DLAG can reach a decision on the application, the TGC requires, within such reasonable time as is specified in the notice, such further information as is so specified The licence agreement itself will spell out the grounds for opposing any renewal and the appeal process to contest any non-renewal. ## Application Timeframe and Phrases Applications are handled via an online portal once completing an enquiry sheet, see https://dlagglobal.com/apply-now/ The typical time-line for the completion of the application is between two (2) to three (3) weeks after pre-approval. However, the application can take as long as eight (8) weeks in certain circumstances List of Documents & Type of Information Needed to Support Application See Schedule 1 which provides a general list of documents, required to apply for a Tobique licence. Dependent upon the specific licence sought. ## Geographical Cover This is generally an outward facing remote licensing jurisdiction where licensees can target markets according to their own risk appetite and guidelines laid down by the DLAG which require extra mitigation measures such as customer enhanced due diligence for some countries (i.e. FATF grey listed). In other cases of unacceptably high risk such as FATF blacklisted and sanctioned territories, these countries will be prohibited. At time of writing the prohibited territories are: Afghanistan, Canadian Provinces of New Brunswick and Ontario, China, Cuba, Central African Republic, Democratic Republic of Congo, Haiti, Iran, Iraq, Israel, Libya, Myanmar, N. Korea, Russia, Somalia, South Sudan, Syria, UK, USA, Yemen and Venezuela. ## Mechanics of the Licence Process There is no limitation on the number of licences that can be granted nor requirement to hold a land based licence. The licence process is open to all suppliers and B2C operators subject to satisfying the suitability and transparency requirements as part of the application process. ## Bad Actor / Cooling Off Periods This is not applicable as this is a newly launched jurisdiction. However all applicants will be assessed on their merits and reputation. ## Applicant Considerations There is no need for a local Tobique company (in fact this is possible) or key persons / staff to be present in the jurisdiction itself. TGC will however need access to the transactional data on demand. There’s a mandatory requirement for the Licensee to have an MLRO/Compliance Officer, Where an acceptable MLRO/Compliance Office should:- Have sufficient experience/capacity/training to conduct role; Maintain a sufficient level of seniority within the firm; Have sufficient resources, including time and if necessary support staff; Conduct the role independently from any other roles held, for example, a director may have commercial priorities, but the MLRO/Compliance Officer needs to conduct their job with a level of independence and ensure the right compliance decisions are made. However, if the operation is only a small operation, then it might be possible for the director to also performing the role. Please note that they could also be a part time employee or a third-party consultant. ## Data Protection Data Protection, Data Security and Disaster Recovery requirements are set out in the General Codes, which can be found on the TGC website https://thetgc.ca/regulatory-documents/ The B2C licensees will be subject to data controller responsibilities in accordance with the laws and regulations of the jurisdictions where they are managed and controlled from. B2Bs servicing them will be deemed data processors, where associated provisions should be covered in the agreements with their B2C operator customers.
