Under the LOK, licensed operators (B2C and B2B where applicable) must ensure marketing and advertising activities, including the offering of bonuses, do not (a) encourage high-frequency/immoderate play, (b) mislead, or (c) target vulnerable persons. Factors relevant to assessing compliance include the quantity, duration, timing, manner and placement of advertising. Operators must additionally consider the local advertising laws of each targeted jurisdiction. A further national decree containing general measures on marketing and advertising is anticipated, under which the CGA may lay down more detailed rules to ensure a responsible offer of games of chance. Mandatory ADR mechanisms apply to licensees generally.
