Federal Bill S-241, introduced in late 2025 as successor to the lapsed Bill S-268, is currently before the Senate and would affirm that the governing body of a First Nation has exclusive authority to conduct, manage, licence and regulate gaming on its lands, an assessed-confidence finding of fragile, pre-enactment instrument status. Bill S-268 itself sought to place First Nations on equal footing with provinces regarding gaming jurisdiction before it was superseded by Bill S-241's introduction, also an assessed-confidence, fragile-instrument finding. If enacted, Bill S-241 would materially strengthen the legal durability of TGC's self-asserted jurisdictional basis by converting an inherent self-government assertion into an affirmed federal-statutory entitlement; if it lapses as its predecessor did, TGC's foundational legitimacy question persists unresolved. This is the single reform item most capable of changing CA-TFN's overall entry-verdict calculus in either direction.
